TurkishIn this Privacy Policy, which is available via a link at the bottom of the homepage www.blaketrader.com, “we”, “us”, “our” and the “Company” means Blake Trader Inc, as well as its affiliates on its behalf, including Blake Games and the various media channels affiliated with Blake Trader such as Telegram and Discord (collectively, “Blake Trader”). This Privacy Policy works hand-in-hand with the Terms and Conditions of Use (hereafter the “T&C”), which can be found here, and any terms that are not defined in this Privacy Policy shall have the meaning given in the T&C.
For the purposes of the Federal Trade Commission Act, the Data Controller is Blake Trader Inc located at 1712 Pioneer Ave, Suite #985, Cheyenne, WY 82001, USA
This Privacy Policy applies to all “users” of the Site. This includes unregistered visitors as well as users who have registered and maintain an account on the Site. This Policy does not cover the Privacy Policies of other web sites, nor any information collected through any other website operated by third parties. Each of these web sites may have a Privacy Policy that differs from ours and we urge users to check the Privacy Policies of each web site that they may visit or interact with.
This Privacy Policy will remain in full force and effect – even if your use or participation in the Site or any particular Service, tournament or game offered through the Site terminates or ceases, or is suspended or deactivated for any reason – in order to ensure that you may easily restart game play at a later time. In any case, should you continue to be an inactive player for more than four years, Blake Trader will delete your personal information.
If you do not agree with this Privacy Policy, please do not participate in the Site or any of the activities or Services offered through the Site.
Collection of information
When you register on the Site we collect Information through the completion by the user of contact forms and surveys, and through his or her interaction with the Site (for example, which games you play, player rating information and game statistics). Users may provide other information about themselves, in addition to the mandatory Personal Information (hereafter “Voluntary Information”). Voluntary Information includes, but is not limited to, information collected when they use features on the Site, such as messages, chats, the “Invite Friends ” feature, or when you contact Customer Support. For example, we collect names and e-mail addresses of the user’s friends when the user uses the “Invite Friends” feature on the Site. We may also require you to provide additional personal information, such as your name, an avatar, age, and address for the purpose of verifying your identity, including your address, in order to participate in our Site.
A. Types of Information
We collect two types of information from you when you visit the Site: non personally identifiable information (hereafter “Non-Personal Information”); and personally identifiable information (hereafter “Personal Information”).
(i) Non-Personal Information
Certain technical information related to your visit to the Site may be automatically recorded. This information is anonymous and does not identify you personally. Non-Personal Information includes, but is not limited to: the Internet domain for your Internet service provider; the Internet Protocol (IP) address of the computer accessing the Site; the address of the last webpage that you visited prior to clicking through to the Site; the browser used and the type of computer operating system that your computer is using; information about your computer hardware; the date and time that you visited the Site; and a record of which pages you viewed while you were visiting the Site. Other information such as demographic information, which does not identify an individual, is also considered Non-Personal Information. Gaming Information (described below) is also considered Non- Personal Information.
(ii) Personal Information
When you register for a user account, you consent to our collection of Personal Information including your email address, for the purpose of validating your email address, and in order to market upcoming game tournaments and email to reminders and promotions regarding the activity on the platform. Gender information, should you agree to provide, are for the sole purpose of Blake Trader better understanding the demographics of our players.
If you receive cash prizes through PayPal, your identifying information will never be released unless subpoena by a court of law. Standard PayPal security would apply to this information.
As noted above, the Site also provide you with certain ways to voluntarily give us your Personal Information. You may also use the features of the Site to invite others to create accounts. We may also collect Personal Information about you if you choose to send us an email message, which contains such information using links contained on the Site. You may also disclose Personal Information when you post content with such Personal Information on the Site or when you contact our Customer Support representatives via live chat or email. Certain information about your activity on the Site is not itself Personal Information (for example, information about your game play preferences) but may be linked to your account information. For example, the following information (“Gaming Information”) is publicly displayed on the Site and, provided it doesn’t identify you personally, shall not be considered Personal Information:
your Username or Alias;
your Points and ELO Ratings;
your friends on Blake Trader;
your ranking (if any);
your scores in games and tournaments;
your User Profile and statistics;
your gaming preferences or your personal motto;
summary of your gaming activity on the Site;
summary of your gaming activity outside the Site;
winnings from games and tournaments; and
any personal information you chose to disclose in a messaging, chat, or your profile.
We may include footage of game play in promotional materials such as trailers which may be displayed on the Site, or on websites run by other parties including those of our marketing partners. For example, we may display highlights or similar content. This content may also include the use of Gaming Information.
By using our services, which may include but limited to playing on our servers or entering into our tournaments, you specifically grant Blake Trader permission to live stream those game play which may include identifying information such as your player name.
We also collect Personal Information to investigate complaints of cheating or behavior that we believe may be contrary to our T&C, including the Code of Conduct. This may include screenshots of players’ footage of in-game play and players' public Steam account information.
In addition to collecting Personal Information directly from visitors to the Site, we may also collect Personal Information from third parties such as marketing partners to which permission has been granted to share that information with us.
When you register with us through the Site, we will ask you for Personal Information. Personal Information includes, but is not limited to, your name, age, country of residence and email address. Once you register for an account on the Site, you may associate your account with your Steam account. Your Steam ID would then be permanently associated with your Site account. If you decide to associate your Site account with your Steam account, which is necessary to withdraw BlakeTokens or to join tournaments, we may extract public Personal Information that you have provided to Steam (such as your “real” name, email address and other information you make publicly available via Steam) from the account you have with Steam. The information we extract may depend on the privacy settings you have with Steam.
B. Cookies
Cookies are small text files that a website can write to your computer. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site. We use cookies to identify you and allow you to log in once to our web site and search or post without having to log in again and again. Cookies are also used by our affiliates or links to identify you as a User of Blake Trader.
As with many major websites, the Site uses cookies. We use Cookies to recognize you when you return to the Site and personalize your settings and preferences. Most browsers are initially set up to accept cookies. If you wish, you can change your browser settings either to notify you when you have received a cookie, or to refuse to accept cookies. Blake Trader does not use Cookies in order to store information such as sensitive financial information. This Privacy Policy only covers the use of Cookies by Blake Trader Inc. It does not cover the use of Cookies by any other 3rd-party or advertisers.
Use and disclosure of personal information
A. Internal Uses
We collect, use and disclose your Personal Information for such purposes to which you consent at the time of collection or in any case prior to such use, and as otherwise permitted or required by applicable law, including to operate our Site; to open and maintain your customer accounts with us; to provide a product or service requested by you; to contact you regarding updates to the Site, your account status, our new products and services and upcoming events; to notify you of changes to our products and services; to collect subscription and entry fees from you; to process payments; for promotional or related purposes, without additional compensation, including with respect to tournaments and the awarding of prizes; to prevent fraud and protect the integrity of the Site; to deliver prizes to you; and to ensure that you comply with the T&C and are permitted to create an account based upon your age and where you reside. We may also, but do not have any obligation to, use Personal Information to contact you regarding changes to the T&C and any other policies or agreements relevant to the Site, including this Privacy Policy. If you use the “Invite Friends” feature, we will use the generated link to track your friends who created user accounts.
When you create your account and when we collect your Personal Information, you can customize these preferences. If you wish to change your account preferences to modify the ways that we contact you, please change your privacy settings in your profile or contact Customer Support.
B. Related Entities and Authorized Third-Party Service Providers
Personal Information will not be disclosed to Third-Party Service Providers and will not be released unless subpoena by a court of law in the United States. We may pass aggregate information on the usage of our website to Third Parties but this will not include Personal Information.
The Site is maintained in the United States of America. If you are located outside of the USA, by using the web site, you authorize the import of your information and its use, as specified in this Policy.
C. Marketing Partners
Personal Information you provide us will not be disclosed to Third Party marketing partners. Only non-identifying aggregate data will be provided.
D. Legal Compliance
There may be instances when Blake Trader may disclose Personal Information without providing notice or choice, as required by applicable laws.
E. Business Transfers
Finally, if our business enters into a joint venture with or is sold to or merged with another business entity, your information may be disclosed to our new business partners or owners and we may transfer your Personal Information to the party or parties involved in the transaction as part of that transaction
F. Disclosure to Users
You are entitled to see the Personal Information held about you and you may ask us to make any necessary changes to ensure that it is accurate and kept up to date. If you wish to do this, please contact us at contact@blakegames.com.
OBTAINING CONSENT
In most cases, when we do collect Personal Information directly from an individual, the Purposes for which the individual provides us with the information will be clear, and as such, consent to the collection and use of Personal Information for those Purposes will be implied by use of the Services. If we choose to use Personal Information already in our possession for a purpose that was not identified at the time we initially collected the information, we will seek the consent of the affected individuals before using this information for the new purpose. Please note that if the new purpose is required by law, Blake Trader is not required to seek the consent of the affected individuals and may not do so. Individuals may withdraw consent to the collection, use and disclosure of their Personal Information at any time, subject to certain restrictions set out in applicable privacy legislation, but should recognize that by doing so they may be unable to utilize the Services and products offered on the Site. When a member uses the “Invite Friends ” feature, we rely on that individual to obtain the consent of their friend to allow us to use that information to invite them to create a user account.
MANAGEMENT OF PERSONAL INFORMATION
We employ security measures to protect, so far as reasonably possible, your information from access by unauthorized persons and against unlawful processing, accidental loss, destruction and damage. We will retain your information for a reasonable period or as long as the law requires or permits, after which it is either destroyed, erased or rendered anonymous to prevent unauthorized parties from gaining access to the information
Further, we require that our advertisers and partners ensure the security of the data that Users provide to them, however, in the event of a breach of their security measures, User agrees that Company will not be liable for any losses or damages.
Blake Trader limits access to Personal Information about Users to employees, for whom we reasonably believe it is necessary, in order to provide products or services.
PRIVACY OFFICER
Blake Trader is accountable for all Personal Information in its direct control. A number of individuals within the Company are responsible for the collection and processing of Personal Information, such as technical and administration personnel. However, in order to assure accountability, Blake Trader has a designated Privacy Officer who is responsible for Blake Trader’s compliance with applicable privacy legislation. Any questions or concerns with regard to the handling and managing of Personal Information by Blake Trader, or in respect of this Privacy Policy should be directed to our Privacy Officer who can be reached at privacy@blakegames.com.
GOVERNING
The Site, Privacy Policy and the T.&C. shall be governed by and construed in accordance with the laws of the United States of America and the state of Wyoming. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the respective State and Federal courts where the claim is brought by you, save where you have legal rights to bring any claim in respect of such a dispute in any other jurisdiction. We nevertheless retain the right to bring proceedings against you for any threatened or actual breach of these terms and conditions in your country of residence, registration or business or any other relevant country. By registering for an account and/or participating in any service or tournament offered on the Site, you agree that any dispute that cannot be resolved between the parties shall be resolved individually, without resort to any form of class action. You further agree that any legal action arising from any dispute shall proceed only in the courts of the United States of America, or as otherwise determined by us, and you hereby submit to personal jurisdiction and venue in such courts for the purposes of litigating any such action.
We make no representation that this Site is operated in accordance with the laws or regulations of, or governed by, other nations. By utilizing the Services and participating in Site activities, you certify that you meet the age and other eligibility requirements for that activity within the Site and the Services as set forth in the T&C. If you do not meet the age and other eligibility requirements, please discontinue using the Site and the Services immediately.
If any provision of these Terms is, for any reason, invalid and/or unenforceable, as determined in an appropriate Court of proper jurisdiction, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. User agrees to replace an invalid and/or unenforceable provision with a valid and/or enforceable provision that most closely approximates the intent and economic effect of the invalid and/or unenforceable provision and shall be interpreted most favorably, when possible, to the benefit of Company.
CHANGES TO PRIVACY POLICY
Blake Trader reserves the right to amend this Policy at any time, in the event that this becomes necessary after initial release, or in the event that it becomes necessary with respect to additional, deleted, modified or amended services provided by Company. Blake Trader will not personally notify you of any amendments to this Policy. Users are urged to check this Policy frequently in order to determine whether any changes have been made. Users understand and agree that continued use of the Company web site assumes that they have read and accepted this Policy, as it may be amended from time to time.
